Article 1 (Purpose)

These Terms govern the rights, obligations, and responsibilities between ANIMA AI Inc. (the "Company") and users in connection with the ANIMA AI service (the "Service").

Article 2 (Definitions)

• "Service" means the AI tool that analyzes publicly available YouTube data and assists content creation such as titles, thumbnails, and scripts.
• "User" means any member or non-member who agrees to these Terms and uses the Service.
• "Output" means recommendations, titles, thumbnail drafts, scripts, and other content generated by AI at the user's request.

Article 3 (Scope of the Service)

The Company provides ① channel/keyword analysis, ② benchmark video discovery, and ③ content-creation assistance (titles, thumbnails, scripts). The Service is a reference tool based on publicly available YouTube data and generally accepted content-creation principles, and does not guarantee any specific results (views, subscribers, revenue, etc.).

Article 3-2 (Use of YouTube API Services)

This Service uses YouTube API Services. By using this Service, you are agreeing to be bound by the YouTube Terms of Service: https://www.youtube.com/t/terms

Article 4 (Fees and Payment)

• The Service is offered as a free plan and paid plans (Pro, Studio, Master). Usage limits, features, and prices for each plan are displayed within the Service.
• Paid-plan prices include VAT; the price displayed at the time of payment applies.
• Paid plans are fixed-term passes that do not auto-renew. When a paid period expires, the account reverts to the free plan without any recurring billing or automatic withdrawal.
• Payments by minors under 19 require the consent of a legal guardian; payments made without such consent may be cancelled by the minor or the guardian (Article 5, Korean Civil Act).
• The Company may change prices or plan composition with prior notice. Changes do not affect passes already purchased.

Article 5 (Withdrawal and Refunds)

• Users may withdraw a purchase within 7 days of payment (Article 17, Korean E-Commerce Act).
• However, refunds may be limited for digital content already delivered and consumed, such as analysis or generation credits already used (proviso to Article 17(2) of the same Act).
• A fixed-term pass is fully refundable within 7 days of payment if no analysis/generation credits were used; otherwise, the amount corresponding to credits already used is deducted from the refund.

Article 6 (User Obligations)

• When producing and uploading actual videos from Outputs, users must verify copyright and portrait rights themselves (thumbnail backgrounds, quoted materials, etc.) and use them only within their lawful rights. Images surfaced via external search (e.g., Google Images) are composition references only; do not use third-party works or likenesses without authorization.
• License-free images provided in the app (e.g., Pexels) may be used within the provider's license; users are responsible for final checks such as portrait rights of people in photos. Users bear all rights and responsibilities for images they upload.
• Users must supplement Outputs with their own real experience and figures, and must not produce videos with false or exaggerated information.
• Users must not abnormally mass-call the Service via automated scripts or use it to infringe the rights of others.

Article 6-2 (Prohibited Use of AI Generation and Moderation)

• Users must not generate, request, or attempt the following with the Service's AI features (scripts, thumbnails, images, etc.): ① obscene or sexually explicit content, or content sexually depicting or implying minors (NSFW, CSAM, etc.); ② content infringing portrait or personality rights, such as non-consensual synthesis or deepfakes of real persons; ③ content promoting violence, self-harm, terrorism, hatred, or discrimination, or depicting/instructing illegal acts; ④ content defaming others or spreading falsehoods.
• Users must not enter prompts intended to bypass safety filters (e.g., "uncensored", "no filter", "unfiltered", "NSFW", "18+").
• To prevent the above, the Company may pre-screen prompts and outputs using external moderation systems (including those provided by payment processors), and may block, delete outputs, restrict use, revoke credits, suspend accounts, block payments, and report to competent authorities as required by law.

Article 7 (Intellectual Property)

Intellectual property rights in the Service and in screens, frameworks, and copy produced by the Company belong to the Company. Users retain the right to use information they input and the Outputs; users bear legal responsibility for the use of Outputs.

Article 8 (Disclaimer)

• Analyses, recommendations, and Outputs are reference materials; the Company does not guarantee any results such as views, revenue, or growth of content produced using them.
• AI Outputs may contain errors or inaccuracies; users are responsible for verifying facts before final use.
• The Company is not liable for damage caused by policy/algorithm/API changes of external platforms such as YouTube, force majeure, or causes attributable to the user.

Article 9 (Changes and Suspension of the Service)

The Company may change or suspend all or part of the Service for operational or technical needs, with prior notice for material changes.

Article 10 (Governing Law and Jurisdiction)

These Terms are interpreted under the laws of the Republic of Korea; jurisdiction over disputes follows the Korean Civil Procedure Act.
